In short: Crypto-assets are volatile, transactions are irreversible, and balances held with Paysell are not covered by any deposit-guarantee scheme. Using Paysell means accepting the risk that the value of your balance falls, that a stablecoin issuer freezes funds, that a mistake in an address cannot be undone, or that regulatory or technical events interrupt the Service. Read this document before you accept your first payment.
1. Purpose of this disclosure#
This document describes the principal risks of using Paysell to accept and hold crypto-assets. It is not exhaustive, it is not investment, tax or legal advice, and it does not change the allocation of risk in the Terms of Service. If you do not understand a risk described here, take independent advice before using the Service.
Paysell supports only the TON network: Toncoin (TON) and USDT issued as a jetton on TON. We offer no fiat currency, no conversion between assets and no hedging: a balance in TON stays in TON, and a balance in USDT stays in USDT, until you withdraw it.
2. Market and price risk#
The market price of TON can change substantially within minutes and can fall to a fraction of its value at the time you accepted a payment, or in principle to zero. Because Paysell does not convert to fiat, the value of your balance moves with the market for as long as you hold it.
Specific consequences:
- An invoice priced in TON exposes you to price movement between issue and payment, and a balance held in the cabinet is exposed to the same movement until you withdraw it, including during any manual review.
- Crypto markets trade continuously, including at times when you cannot act, and can be illiquid.
3. Stablecoin risk#
USDT is a stablecoin issued by Tether, a private company. Holding USDT is a claim on that issuer, not a holding of United States dollars, and it carries its own risks:
- De-pegging. The market price of USDT may fall below one US dollar, temporarily or permanently, if confidence in the issuer's reserves falls.
- Issuer freeze. Tether has the technical ability to blacklist addresses and to freeze the USDT they hold. If an address in our custody chain is frozen — including because of funds received from a third party we did not screen — the affected USDT may become permanently unavailable, and Paysell will not be able to pay it out.
- Issuer failure. The issuer may become insolvent, be sanctioned, or suspend redemptions. Paysell has no insight into and no control over its reserves.
- Jetton contract risk. USDT on TON exists as a smart contract; a defect in it may affect transfers.
4. Irreversibility and user error#
Blockchain transactions are final: there are no chargebacks, and neither Paysell nor any authority can reverse a settled transfer. Most losses in practice come from mistakes, not attacks:
- Wrong payout address. If you save an incorrect withdrawal address, funds sent to it are lost. Verify every character rather than retyping an address.
- Wrong network. Assets sent on a network other than TON — for example USDT on Tron or Ethereum — will not arrive and are generally unrecoverable.
- Wrong asset to an invoice address. If a buyer sends TON to a USDT invoice or vice versa, the amount received is credited to your balance in the asset actually sent and the invoice stays open, as described in the Refunds, Disputes and Chargebacks policy.
- Comments and memos. TON transfers may carry a comment. Sending funds without the payload or memo a destination service expects — an exchange deposit address, for example — can credit them to the wrong party.
- Late payments. Funds arriving long after an invoice expires may not be matched to the order they were meant to settle.
5. Network and technical risk#
Paysell depends on infrastructure it does not own:
- The TON network may experience congestion, elevated fees, forks, validator incidents or outages, during which payments and withdrawals may be delayed or fail.
- We confirm payments after inclusion in the masterchain plus three further masterchain blocks, cross-checked against a second data source — a practical standard, not an absolute guarantee against deep reorganizations or data-provider error.
- Third-party data providers and node infrastructure may be unavailable or return incorrect data, delaying credits and webhooks.
- Availability of the cabinet and API is best-effort; see Service Availability and Support.
6. Custody, operational and cyber risk#
Paysell is a custodial service. Between payment and withdrawal the crypto-assets are controlled by Paysell's wallets and your entitlement is a record in our ledger — you do not hold the private keys.
- Custody risk. If Paysell's keys were compromised, lost or destroyed, or if the company became insolvent, you might not recover your balance in full or at all. We separate hot and cold funds and review every withdrawal manually, but no custodian is risk-free — see Security and Responsible Disclosure.
- Account takeover. If your email, password or two-factor device is compromised, an attacker may change your payout address and drain your balance. Enable two-factor authentication, store recovery codes offline and review your sessions.
- API key exposure. A leaked API key allows an attacker to create invoices in your name. Keys are shown once and can be revoked at any time.
- Insider and process risk. Manual withdrawal review makes human decisions and human error part of the process; operator actions are recorded in an audit log.
- No deposit insurance. Balances held with Paysell are not bank deposits, are not e-money, and are not protected by any deposit-guarantee or investor-compensation scheme in any jurisdiction.
7. Regulatory and counterparty risk#
The regulation of crypto-asset services is developing rapidly and differs by country; our own position is stated in the Regulatory Status Statement. Changes in law, licensing requirements, sanctions regimes or the position of our infrastructure providers may require us to restrict features, suspend accounts, refuse withdrawals to particular addresses, or cease operating in a territory, at short notice and without compensation.
We may also be required to freeze funds or disclose information on a lawful request from an authority. As explained in the AML/CTF and Sanctions Policy, we do not operate automated sanctions screening or transaction monitoring today, so suspicious activity may be identified late and a freeze may occur after funds have been credited.
You remain responsible for your own compliance: your right to operate your business and to accept, hold and convert crypto-assets is a matter for the law that applies to you.
8. Tax#
You are solely responsible for determining, reporting and paying any tax arising from your use of the Service, including on the receipt, holding and disposal of crypto-assets. Paysell does not provide tax advice and does not withhold or report tax on your behalf, except where required by law.
9. Limited recourse#
If a risk in this document materializes, your recourse against Paysell is limited to what the Terms of Service provide. Paysell is not liable for market price movements, the acts of a stablecoin issuer, network conditions, your errors in addresses or assets, or losses following a compromise of your own credentials.
10. Acknowledgement#
By registering an account and accepting payments through Paysell, you confirm that you have read and understood this disclosure; that you act in the course of a business and not as a consumer; that you can bear the total loss of any balance held with Paysell; and that you have not relied on Paysell for investment, tax or legal advice.
